These Terms of Service ("Terms") govern your access to and use of CaseFill, a web-based legal forms software application operated by CaseFill ("we," "us," or "our"). By creating an account or using the service, you agree to be bound by these Terms.

1. Description of Service

CaseFill is a cloud-based software application that helps California attorneys, paralegals, and legal professionals prepare Judicial Council and local court forms. The service includes auto-fill capabilities, form packet generation, digital signatures, team collaboration tools, and document management features.

2. Eligibility

CaseFill is intended for use by licensed attorneys, registered paralegals, and authorized legal professionals in the State of California. By using CaseFill, you represent that you are authorized to prepare legal documents in your capacity and that you will use the service in compliance with all applicable laws and professional rules of conduct.

3. Account Registration

You must create an account to use CaseFill. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Billing

CaseFill is offered on a subscription basis. Pricing is per user per month, with discounts available for annual billing. All fees are non-refundable except as required by law. We may change our pricing with 30 days' advance notice. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

5. Free Trial

We may offer a free trial period. During the trial, you have full access to all features. At the end of the trial, you must subscribe to continue using the service. We will not charge you unless you affirmatively subscribe to a paid plan.

6. Your Data

You retain all ownership rights to the data you enter into CaseFill, including matter information, party details, generated documents, and any other content. We do not claim ownership of your data. You grant us a limited license to host, store, and process your data solely to provide the service to you.

7. Acceptable Use

You agree not to use CaseFill to violate any applicable law or regulation, infringe on the rights of others, transmit malicious code, attempt to gain unauthorized access to our systems or other users' data, or use the service for any purpose other than legitimate legal document preparation.

8. Form Accuracy and Disclaimer

CaseFill provides form templates based on Judicial Council and local court publications. While we make every effort to keep forms current and accurate, we do not guarantee that every form is the most recent version at all times. It is your professional responsibility to verify that any form you generate is the correct version, properly completed, and appropriate for your case.

CaseFill is a document preparation tool, not a legal advice service. We do not provide legal advice, and use of CaseFill does not create an attorney-client relationship between you and CaseFill.

9. Service Availability

We strive to maintain high availability of the service but do not guarantee uninterrupted access. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of planned maintenance when possible.

10. Intellectual Property

CaseFill, including its software, design, and documentation, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the service during your subscription period. Judicial Council forms are public documents and are not owned by CaseFill.

11. Limitation of Liability

To the fullest extent permitted by law, CaseFill shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service. Our total liability for any claim related to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless CaseFill and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Termination

You may cancel your subscription at any time through your account settings or by contacting us. Monthly subscriptions end at the close of the current billing period. Annual subscriptions retain access through the end of the paid term. We may terminate or suspend your account for violation of these Terms with written notice.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of CaseFill shall be resolved in the state or federal courts located in Fresno County, California.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service at least 30 days before they take effect. Continued use of CaseFill after changes take effect constitutes acceptance of the updated Terms.
